New York executive files $60 million libel lawsuit over insurance scandal

Tuesday, August 23, 2011

A former Marsh & McLennan Cos. executive has hit former New York Governor Eliot Spitzer with a $60 million defamation lawsuit over an online magazine article regarding an insurance bid-rigging scandal.

William Gilman, a former Marsh managing director, filed a complaint last Friday in the U.S. District Court in Manhattan, over allegations Mr. Spitzer defamed him in a Slate article published a year ago. A copy of the complaint was made public on Monday.

Gilman, who had a final insurance fraud charge dismissed in January, said Spitzer acted with “actual malice” by suggesting that he was guilty of crimes of which he was never accused.

Although he wasn’t named in the article, Mr. Gilman complained that Spitzer defamed him by writing that “Marsh’s behavior was a blatant abuse of law and market power: price-fixing, bid-rigging and kickbacks all designed to harm their customers and the market while Marsh and its employees pocketed the increased fees and kickbacks.”

“While Mr. Spitzer’s statements do not refer to Mr. Gilman by name, Mr. Gilman is readily identifiable as the subject of the defamatory comments,” said the complaint. “Mr. Spitzer was well aware of his own allegations as attorney general and the resolution of those allegations in favor of Mr. Gilman and yet, recklessly disregarded these facts.”

In 2004 Mr. Spizter, then the state’s Attorney General, announced an investigation into the practices at Marsh & McLennan, particularly fees paid by insures to brokers who place business with them. Gilman, who worked for the company at the time, was charged in 2005 with 37 counts of insurance fraud. Gilman’s final charge was dropped last January.

“I haven’t seen the lawsuit and so will not comment on it,” said Spitzer. “The illegalities rampant at Marsh & McLennan leading to their fine of $850 million and the multiple judicial findings of illegality are clear from the public record.”

Mr. Gilman is now seeking at least $10 million in compensatory damages; $20 million in general damages, including damage to his reputation; and $30 million in punitive damages.

Salvia Divinorum What Is So Special About It ?}

Salvia Divinorum What is so special about it ?

by

Terrill Joey

Salvia is the most commonly seen plant in mint family, Lamiaceae, with approximately 900 types of shrubs and annuals. It in folk’s tongue referred as sage. When used without specific names, sage generally refers to officinalis family, means common salvia; but, specific names are required to refer particular species amongst all. Ornamental ones are generally called salvia, as it is called in science. But there are one particular type of salvia that has psychidelic effects. Do not assume that this is another article, claiming a stupid plant to prove more psychoactive than LSD or other drugs. It is proven by scientists that, as long as the drug is completely natural, Salvia Divinorum is the most potent and best natural drug known. It can be eaten, chewed or smoked in water pipes. It has a unique psychoactive compound called Silvinorin and it is effective even in tiny masses such as 200 micrograms. This unique psychidelic compound also has a unique effect. It is completely different than alcohol, or any lysercig acid amide or cocaine. Although its effect is fairly brief compared to them, the feeling in those brief moments are invaluable. A cold breeze sweeps through your face and it feels like blood in your veins is the only thing left warm, of your body. Then the time stops for a moment, and slowly resumes to its normal speed. During this period, everything happens slowly, as if you are given more chance to think in a short time, and time, doesn’t recede as fast as it should. Something stirs inside you and yells motion’s edge closing in to calamity. Inevitably you decide you need more air, and breathe harder. As you do so, a itchy tornado ensnares you and brings warmth. You dare open your eyes, and notice, with despair, that time is back into its pace, and you just passed through a black hole, in space. Whether because of what you have just lived through, or as further effects of Salvia Divinorum, a sensation of calmness, relax, insight and patience surrounds you. Despite the real awe, lasting only several thrilling minutes, this, may take hours or even days, depending on how much Silvinorin your body hath encountered before. It is likely to be the reason that in many cultures, these leaves are used in divinations and cultural activities. Most probably they believed this leaf to provoke prohecies and lets one gain visions of future. Maybe even depending on he calmness it bestows afterwards, may be thought that it grants wisdom.

According to studies of an assistant professor in Iowa University, it has proven that Salvia Divinorum also has analgesic effects. This points out the possibility that Salvia, to put it bluntly, can work as a natural painkiller. Since, other investigations made, following this recent one provided us with the information that Salvia Divinorum does not have hazardous effects on any body organs, nor initially or later. This increases the value of this herb in great deal, opening a path for it to be used widely in healthcare and medicines. Since there is no proof that this cause any addiction, it is, at least with the information we currently posess, proves to be way better than morphine ir default painkillers. It is still unknown to us that if increased dosage of it cause any malfunction in body units, but this herb tends to replace places with what we use as painkillers in medicines right now.

Egyptian doctor sentenced to fifteen years jail, 1,500 lashes in Saudi Arabia

Friday, November 14, 2008

Raouf Amin el-Araby, a 52-year-old Egyptian doctor who has been serving the Saudi Royal family for 20 years, was convicted of malpractice. Egyptian newspapers reported that he was accused of driving a Saudi princess “to addiction”, reportedly after treating a Saudi princess with painkillers.

Initially sentenced to 7 years and 700 lashes, he has been sentenced to 15 years and 1500 lashes, 70 a week, after making an appeal.

Family members, friends and colleagues gathered in outrage and grief outside the headquarters of Egypt’s doctors union, calling upon King Abdullah to pardon Raouf. “1,500 lashes is unprecedented in the history of Islam,” read one banner carried by protesters. “Who is responsible for the humiliation of our doctors abroad?” read another.

The Egyptian Organization for Human Rights (EOHR) and the foreign minister are working hard to find a way to return Raouf home quickly. Hafez Abu Saeda, the director of EOHR, stated that the princess was prescribed the same medication that she was receiving in the United States, “so it is obvious that the doctor was not at fault for her addiction.”

Abu Saeda was astonished that the judge doubled the sentence and the lashes after the appeal. It is tantamount, he said, to penalizing Amin for asserting his right of appeal. “When you appeal against a sentencing it is the rule that it cannot go higher, but in Saudi Arabia it appears anything is possible,” said Saeda.

Protests in Egypt have driven the Egyptian foreign ministry to seek a solution, partly out of concern that negative repercussions may damage relations between Cairo and Riyadh.

A human rights lawyer said that he was given the first 70 lashes last week and he will get 70 more this week.

Texas police name ‘person of interest’ in DeBerry woman’s disappearance

Wednesday, March 19, 2014

On Monday, Texas police identified Rodris Webster, 25, as a person-of-interest in the recent disappearance of a 19 year-old woman. The woman, Alicia Benefield, of DeBerry, Texas, was reported missing on Friday.

Webster is described as Benefield’s boyfriend. He was arrested in January and charged with aggravated assault with a deadly weapon. Benefield was the complainant in that charge according to media reports. Webster remained jailed until Benefield dropped the charge on March 5.

Police investigators inspected a trash dumpster located in the nearby town of Waskom on Sunday morning. In it they reportedly found Webster’s wet, muddy hoodie with Benefield’s keys in the pocket. Police interviewed Webster for 5 hours on Sunday, but released him around 6pm. The woman, still missing on Tuesday morning, is described as petite size, about 110 pounds, with a nose piercing and a tattoo on one arm saying “Wanda Ree”. She was last seen wearing a white sweater and brown tights.

A police official told reporters Webster had not confessed to any criminal activity: “The story is out there that he has confessed and we do not have a confession”. Benefield’s mother told reporters she expects her daughter to call her. “She is going to call. I’m going to be the first one she calls, matter of fact. I don’t care how mad she think[s] I am. She’s going to call me.”

Malaysian government warns citizens about Uncyclopedia

This article mentions the Wikimedia Foundation, one of its projects, or people related to it. Wikinews is a project of the Wikimedia Foundation.

Tuesday, January 15, 2008

Satire site Uncyclopedia, a parody of online encyclopedia Wikipedia, has been labeled by the Malaysian government as dangerous. The Internal Security Department of Malaysia issued the warning today, saying that the site has “messages and information insulting Malaysia”.

The warning notes the creation date of the website as being 5 January 2005, and hosted by Wikia, Inc., both of which are correct. However, it claims Wikia owns Wikipedia; Wikipedia is a charitable non-profit website owned by the non-profit Wikimedia Foundation, while Wikia is an independent, for-profit company.

The report evidently mentions that Uncyclopedia covers Malaysian “history, culture, the political leaders, the government, the national song and the name / history of the national flag,” none of which is “correct”. They accuse the website of helping to reinforce a bad international image of their country.

There are no reports of the site being blocked from access within the country, only this statement, which urges Malaysians not to circulate the content.

Uncyclopedia’s article on Malaysia begins:

Essentially the penis of Asia which is located to the north of their cousins who live on an even smaller island Singapore, Malaysia (also known as Bolehland) is a young nation of diverse cultures and races such as F1 Formula-1 and Nascar. The timezone of Malaysia is unique because it follows the system of +1/+2 PMT (Predetermined Meeting Time) which is 1 or 2 hours later than PMT. Most foreigners have difficulty adjusting to this new timezone as they tend to show up 1 or 2 hours earlier than the local counterparts. The nation is moving forward with a vision towards becoming a developed nation by the year 2020, 3030, 4040 or whatever catchy number.

…Another common state that Malaysians have is denial (no lah, where got?), which incidentally, is a river in Egypt.

The site has fired back with a parody article posted at the site under their UnNews section, titled Uncyclopedia Internal Security Department warns on Malaysia. The article suggests that the “Internal Security Department of the Uncyclomedia Foundation,” which is a facetious and fictitious parent organization of Uncyclopedia, identifies Malaysia “as a dangerous country… It warned its people not to use the country today.”

There are forty-seven individual language editions of Uncyclopedia, including Tolololpedia, which is written in Bahasa Melayu, the Malay language. This is in addition to fictional “language” editions which include Oscar Wilde, Newspeak, N00b, White Supremacist, and Re: PharmaccgRy.

Blu-ray prevails in high definition disc war

Wednesday, February 20, 2008

The battle between the two high definition optical disc formats, Blu-ray and HD DVD has ended after sole HD DVD manufacturer Toshiba has announced it will no longer produce HD DVD players.

In a press conference yesterday, Toshiba president Atsutoshi Nishida announced and confirmed that Toshiba will terminate the R&D plan on HD-DVD products. The key issue to force Toshiba terminating their HD-DVD R&D plan was Warner Bros., who changed their R&D plan from HD-DVD to Blu-ray on January 4.

In what is a reverse of the VHS vs Betamax format war, Sony‘s Blu-ray has come out on top with the backing of major studios and retailers such as Warner Bros. but also Wal-Mart, Best Buy, Netflix, and Blockbuster who announced they would only support Blu-ray exclusively this past month.

Even though Toshiba is currently about to change their R&D plan from HD-DVD to NAND flash drives and micro drives and plan to build two factories in Iwate, Japan, the company will provide the maintenance service on discs and players in the future 8 years.

Sony bundled Blu-ray into their PlayStation 3 game system. Microsoft’s competing Xbox 360, comes with a $200 HD DVD add-on player, whose fate is now undetermined with the demise of HD DVD. Microsoft has said they will wait for what Toshiba has to say.

How Changes In Technology Affect The Dissolving Pulp Industry

By Adrianna Noton

Dissolving pulp is bleached wood pulp with a high cellulose content. Bleaching the soft wood tissue removes or decreases the color of the pulp. The main use of the bleached wood tissue is to make paper. It is also used to make rayon materials that are in turn, used in the manufacturing of clothing items like jackets, shorts, shirts, and coats. In addition, rayon materials are used to make cellophane.

The decrease in the paper and print industry has been strongly influenced by the advent of the internet and technologies for mobile computing. The technologies that will strongly impact this industry, are e books, e commerce, digital archiving, and online news. People are increasing their use of these technologies daily, which will lead to a drastic decline in the use of paper. The increase in online technology will in turn decrease the demand for bleached pulp as well.

The medical community is a prime example of the decrease in paper and the dependence on computer technology for patient care. Patient files and laboratory testing orders are entered for each patient into a secured online database that is shared by the particular health care facility or hospital. Insurance and patient billing is also completed online. The decrease in the use of paper just among medical organizations is substantial.

Throughout the business world the move to switch from paper reports, files, and records, to the many software products available, has slowly but strongly influenced the viability of the paper producing industry. With the advances in technology that will help companies run their business more efficiently and cost effectively, the need for paper products could become almost non existent.

Companies will need to adapt to these changes in order to stay in business. The industry will need to investigate other opportunities for the use of the fibers that can be derived from the bleached wood tissue.

The switch from producing paper products, for instance, to the production of rayon will take advantage of the cotton industry which is currently struggling. The rayon substance is used in the clothing industry and its production will offer the opportunity to adapt to the changing industry.

Heavy rains, floods, and other restrictions, have caused a sharp decrease in cotton production which is increasing the demand for rayon. In some areas of Asia the market has grown by as much as ten percent annually. This is an indication that the dissolving pulp industry needs to explore alternative products to remain viable.

With the increase in technologies that are moving businesses away from the need for paper products, and the decrease in the output of cotton that is needed for clothing and other items, the dissolving pulp industry will be able to survive provided those who own the mills are able to adapt. While it may take the closing of a mill to make the necessary changes to adapt, the results of making the switch will help keep the industry alive by making the most of a changing situation.

Triple limb-reattachment fails – boy loses foot

Tuesday, April 5, 2005Terry Vo, the 10-year old Australian boy who had two hands and a foot reattached by surgeons after losing them in an accident, has had to have the foot re-amputated. He will be given a prosthetic foot in its place.

The operation to re-attach three limbs was thought to have been a first – but was ultimately unsuccessful, with the foot having died inside, and receiving insufficient blood supply following the surgery to reattach it.

“That would lead to the small muscles in the foot actually constricting, the toes bending over and a deformed …. foot that is sort of clawed over and doesn’t have good sensation,” said plastic surgeon, Mr Robert Love today, on Australia’s ABC Radio.

“Even if you can get all of that to survive, he [would be] worse off than having had an amputation.”

“What is very disappointing is that for the first two days after [the operation] the foot looked absolutely magnificent,” he said.

Terry’s hands were healing well, said the surgeon. The prosthetic foot would allow him to walk normally, since his knee was intact.
