The European Parliament has rejected the directive on the patentability of computer-implemented inventions (software patent directive) sustained by lobbies of large software publicists such as the corporations Microsoft, Siemens, Nokia and Alcatel, grouped under the title of the European Information & Communications Technology Industry Association (EICTA, [1]). The directive involved the granting of software patents.

648 MEPs out of 680 rejected the text, 18 voted for and 14 abstained.

A rejection vote became the expected outcome when the European People’s Party, initially in favour of the directive, decided to reject it.

The European Greens, Socialist Group and European Liberal Democrat and Reform Party also voted for rejection of the directive for heterogeneous reason. Michel Rocard, author of a number of amendments to the original directive, said that the majority of the modifications were unlikely to be supported by the Commission and Council, with whom the Parliament would have had to enter a Conciliation procedure if it had voted for maintaining the directive in moditifed form. “Better have no text at all than a bad one”, he added.

Before the vote, Rocard pointed at the irritation of the Parliament towards the Commission: “There is collective anger throughout the Parliament because of the way the directive was handled by the Commission and the Council”.

During the debate on Tuesday, Commissioner Joaquín Almunia told MEPs: “Should you decide to reject the common position, the Commission will not submit a new proposal.”.

The rejection was welcomed by small and medium software companies, as well as by Free Software supporters. The Directive had been subject to an intense campaigning, within the Parliament, in the news media and on the Internet. The supporters of the Council position appear to have spent several ten millions, hiring prestigious PR agencies with at least 30-40 lobbyists who roamed the halls of the Parliament every day for 3 months, and many full-page advertisements in EU newspapers such as European Voice, EU Reporter etc. The opponents of software patentability (that is supporters of the position taken by the European Parliament in its 1st reading of 24 September 2003), coordinated under the roof of the Foundation for a Free Information Infrastructure (FFII), also had several lobbyists stationed in Brussels, conducted several conferences and demonstrations and published some newspaper advertisements, with a total budget of nearly 100,000 eur apart from countless unpaid working hours of a dedicated supporter base, consisting mainly of programmers and software entrepreneurs.

ABC News yanks 20/20 investigation of Tom Cruise and Scientology

An investigation into Scientology and Tom Cruise which was set to air this past Friday on the American television program 20/20 was removed from broadcast by ABC News. This is not the first time that ABC News has pulled an investigation into Scientology from airing on 20/20.

A press release published by ABC on Thursday announced the scheduled airing of the investigation. It described the program as “an in-depth look” by Elizabeth Vargas into the recent report on Tom Cruise and Scientology by journalist Maureen Orth for Vanity Fair in its October 2012 publication.

An analysis of the situation by Editor-in-Chief Tony Ortega of The Village Voice pointed out that in 2008, actor and former Scientologist Jason Beghe was interviewed by Elizabeth Vargas after he had flown to New York. Beghe recounted to Vargas his experiences within Scientology and his decision to cease activity in the organization.

However, this interview by Vargas was never shown on ABC.

ABC caved again, and this time much more publicly.

Ortega noted, “Then, Friday night, ABC caved again, and this time much more publicly.” He highlighted a television screenshot which displays clearly the description given by ABC for the 20/20 program scheduled for Friday: “20/20. New. ‘Lovestyles of the Rich and Famous; The Camera Never Lies’ Journalist Maureen Orth discusses her recent article in Vanity Fair on Scientology and actor Tom Cruise; celebrity”.

According to Ortega, this was to be a significant investigation into Scientology. It was going to cover topics including the recent divorce of actress Katie Holmes from Tom Cruise, the role of minors within the Scientology organization, material on Scientology’s chief David Miscavige, and controversy regarding the elite Scientology group known as the Sea Org. Ortega was himself interviewed as part of the investigation, which he was told would comprise an hour-long broadcast.

We just got word that both ABC 20/20 & Nightline have pulled the TV shows that were going to air tonight.

In addition to Ortega, former Scientologists Marc Headley and his wife Claire were interviewed by ABC News for the 20/20 piece which they were informed would be complemented by a news segment on Nightline. Claire told the camera of her two mandatory abortions she experienced while a member of the Sea Org in Scientology; Ortega reported that this interview moved the ABC television crew to tears.

Marc Headley confirmed that he had learned of the ABC News decision. In a post Friday to a legal fund webpage he set up to support his family with litigation costs from Scientology, he commented: “We just got word that both ABC 20/20 & Nightline have pulled the TV shows that were going to air tonight. It appears that someone at OSA is trying to sandbag the downstats over the next few weeks.” OSA is an abbreviation for the Office of Special Affairs — a department within Scientology which has been compared to an intelligence agency that handles legal affairs and public relations. Downstat refers to a negative impact on statistics gathered by Scientology members of the Sea Org due to critical investigations of the organization by the media.

Southern Ocean whale slaughter to resume

The international environmental organisation, Greenpeace, have been shadowing a Japanese whaling fleet currently operating in the Southern Ocean in Australian Antarctic Territory. They claim a minor victory against the six-vessel fleet, saying no whales have been killed since Christmas Eve. However they expect a resumption of whaling and protest activity soon.

Greenpeace has two ships, MV Esperanza and MV Arctic Sunrise, active near Antarctica, in an effort to disrupt the whalers, who intend on slaughtering over 900 Minke whales and 10 Fin whales in the region this summer. The activists aim to stop the Japanese whaling fleet as it tries to catch nearly 1000 whales for what is claimed to be scientific research.

Greenpeace chief Steve Shallhorn states that the protesters have chased the six-ship fleet northwards, with the vessels now away from the designated whaling zone. Greenpeace plan to maintain their efforts to keep the whalers in the public eye.

“What the fleet is doing is trying to outrun Greenpeace so that it can sneak back into the whaling grounds and resume the kill,” he said. “And for that very reason, we’re doing our very best and are succeeding in keeping up with the factory whaling ship. We are certain that they do not want any further publicity.”

He said Greenpeace will continue its high-speed tailing for as long as it takes. “We’re capable of staying out there for many more weeks,” he said. “The [Japanese] fleet is clearly embarrassed by having their actions exposed to the world, since the spotlight on their activities shows what it really is – commercial whaling with a very thin disguise.”

The whalers have been unable to kill any whales since Christmas Eve due to poor weather and harassment by Greenpeace vessels, and the Washington-based Sea Shepherd ship, RV Farley Mowat. The Sea Shepherd is operating independently of Greenpeace but say they are working towards a common objective – “the shutting down of illegal whaling in the Southern Ocean.”

Greenpeace expedition leader Shane Rattenbury says the whalers have a season of about 100 days. “Their quota is 945 whales. If you lose, say, 10 per cent of those through bad weather, they’ve got an average they need to catch of 10 a day and it’s gone 10 days now without having any whales,” he said. “That starts to add up pretty quickly. They’re under a bit of pressure to get on with the business.”

Japan’s Institute for Cetacean Research have rejected the claims made by Sea Shepherd, that Japanese warship was being sent to Antarctica to protect the fleet against the activists.

The Japanese institute spokesman condemned Sea Shepherd over the claim by Farley Mowat captain Paul Watson, who called on the Australian Government to keep the peace.File:Greenpeace Vessels Esperanza and Arctic Sun.jpg

Sea Shepherd had requested the presence of the Australian navy to monitor events in the Southern Ocean. However, Australia’s environment minister, Senator Ian Campbell, said that Sea Shepherd’s threats to attack the fleet “risk setting back the cause of whale conservation many years”.

Capt Watson said yesterday: “Stop threatening us, Mr Campbell, and charge us if you believe we are acting unlawfully. Stop posing for the Japanese [who] are in blatant violation of international conservation laws.”

Japan’s Fisheries Agency, which conducts the whaling, said the claim was a tactic by Sea Shepherd to try to raise the stakes for extra publicity.

“This is why the environmentalists’ campaign in the Antarctic is a PR stunt: every time they get some media coverage there’s always some member not too far away asking the public for money,” an agency spokesman said in a statement. “Only this time, it completely backfired and now people will question what these groups say.”

The spokesman had no response to Greenpeace’s claim that another vessel had joined the whaling fleet and was refuelling the ships within the boundary of the Antarctic Treaty’s nature reserve.

Mr Rattenbury said the 57 activists and crew aboard the Greenpeace ships were in good health following a quiet New Year’s Day celebration on deck under a midnight sun.

He said his ships were not in contact with the Farley Mowat, which is believed to be closer to the Antarctic ice shelf. The Farley Mowat’s weblog quoted ship captain Paul Watson as saying the Sea Shepherd group had no conflict with Greenpeace, despite earlier British media assertions.

“As far as I am concerned both Sea Shepherd and Greenpeace are working towards a common objective – the shutting down of illegal whaling in the Southern Ocean,” said Paul Watson.

Greenpeace believes the fleet killed at least 25 whales from the time it contacted the whalers just before Christmas.

Wikinews interviews Frank McEnulty, independent candidate for US President

While nearly all cover of the 2008 Presidential election has focused on the Democratic and Republican candidates, there are small political parties offering candidates, and those who choose to run without a party behind them, independents.

Gastric bypass surgery performed by remote control

A robotic system at Stanford Medical Center was used to perform a laparoscopic gastric bypass surgery successfully with a theoretically similar rate of complications to that seen in standard operations. However, as there were only 10 people in the experimental group (and another 10 in the control group), this is not a statistically significant sample.

If this surgical procedure is as successful in large-scale studies, it may lead the way for the use of robotic surgery in even more delicate procedures, such as heart surgery. Note that this is not a fully automated system, as a human doctor controls the operation via remote control. Laparoscopic gastric bypass surgery is a treatment for obesity.

There were concerns that doctors, in the future, might only be trained in the remote control procedure. Ronald G. Latimer, M.D., of Santa Barbara, CA, warned “The fact that surgeons may have to open the patient or might actually need to revert to standard laparoscopic techniques demands that this basic training be a requirement before a robot is purchased. Robots do malfunction, so a backup system is imperative. We should not be seduced to buy this instrument to train surgeons if they are not able to do the primary operations themselves.”

There are precedents for just such a problem occurring. A previous “new technology”, the electrocardiogram (ECG), has lead to a lack of basic education on the older technology, the stethoscope. As a result, many heart conditions now go undiagnosed, especially in children and others who rarely undergo an ECG procedure.
